Lawyers Probe Strategies to Ward off Foreclosures

Lawyers have formed a group to probe strategies to ward off foreclosures. Michael Wasylick of Florida Foreclosure Defense Bar Association said, “Some people give up without finding out what options they have.” His advice to them is not to give up but to “pick up the phone.” He added, “We want to show that it works.”
The main aim of the body is to help other legal colleagues who are handling foreclosure issues. Foreclosure filings have gone up sharply and there are so many rules involved that it has developed into a specialized branch of the law. Those who are experts can instruct other attorneys about spotting instantly predatory lending or other activities in violation of federal and state laws relating to mortgage.
During 2006 and 2007 Florida was first in mortgage fraud numbers according to the statistics of FBI.
One of the most important things that a homeowner should not do is to fight the foreclosure alone facing a bank as an adversary. Taking proper advice is essential. There are many non-profit groups that offer help without charging anything. Hiring of a lawyer allows expert navigation through choppy waters of the fearful legal process.
For the lawyers the first legal action is very simple – insisting on the production of the original mortgage note by the lender. This is not easy for the bank to do because of the mess they have made in parceling, slicing and reselling the loan to various investors across the globe. Lori Patton a bankruptcy attorney of Longwood and a recently joined member of the group said, “Suddenly instead of having one owner of your note, you have a hundred. Make them show the note.” Such an ordinary routine request could often buy time for the harassed borrower. Patton said that this move has managed to postpone foreclosure for quite a number of years in some of the cases.
Foreclosure cases are clogging the courts of Florida. It swelled to 370,000 in 2008 from 74,000 in 2006 marking an increase of 400%. But there was no simultaneous upgrading of the court structure to handle the flood. The gap in the court system has led to corresponding stress in the families facing foreclosure. It will not disappear overnight.
The Centre for Responsible Lending apprehends that before 2009 draws to a close there will be 2.4 million foreclosures across USA. In Florida the number predicted is 423,731.
