Despite the steady efforts of the federal government to prevent foreclosures, the foreclosure crisis scenario in Ohio is rather dismal. Definite steps have been taken to slow down foreclosures. Having observed a rise in about thirty percent within a span of two years, 2005 – 2007, the government has assigned d nearly 1300 advocates form the government sectors as well as private agencies, to aid and guide house owners from escaping the vicious grip of the foreclosure through litigation. The situation is rather sad with at least one house out of 58 has been seized.
Initially the Ohio government wanted to sit and deliberate over the problem along with the borrowers, in the presence of the court judge. Later it was thought prudent to employ lawyers because the filing for a mortgage requires the service of a lawyer who is a legal expert. Since most of the property owners are incapable of employing lawyers for their jobs, the government felt it would be beneficial to assign them with the task of rescuing owners from the crisis.
The role of the lawyer is twofold. Firstly, they have to find out whether there is fraud involved, leading to a forced foreclosure. Secondly, along with the loaner they need to find out ways of escaping a foreclosure with some logical defense. Their work further extends to working out a settlement with the financer or goes for litigation.
Often it has been observed that the rates if interest that go unrecorded or the loans that are at times taken without any written document, form solid grounds for the owners defense. Thus filing for a foreclosure is quite often illegitimate. The Ohio government has made it mandatory that only written documents regarding real estate will be considered valid and legal.
Nearly fifty percent of the total number of owners could put up strong defenses against foreclosure of their property. In most of the cases it is usually a monetary loss due to either health problems or termination of one’s job. There are others who are victims of fraud, duped outright by the lender. The remaining few could be those who went into a mindless purchase of property without realizing the consequences in case of financial disaster.
Though the fight is between the loan takers and the lenders, the government has concerned itself is simply to foil the efforts of the financiers to target middle class people who do not comprehend the mathematical trickery – hence the employment of lawyers into the affair.
